Divorce in England and Wales operates under the no-fault divorce system. This means that one or both spouses simply confirm that the marriage has irretrievably broken down. No blame needs to be proved.

The main stages are:

  • Divorce application – made by one spouse (sole application) or together (joint application).
     
  • Waiting period – a built-in time for reflection before the court progresses the application.
     
  • Conditional Order – the court confirms there is no reason the divorce cannot proceed.
     
  • Final Order – once granted, the divorce is legally complete.
